Terms and Conditions

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Whitestone Trust Credit Union ("Bank," "we," "us," or "our"). By opening an account, using our banking services, accessing our website, or otherwise engaging with us, you agree to be bound by these Terms. Please read them carefully.

1. Account Terms

1.1 Account Opening

To open an account, you must provide accurate, complete, and current information as part of the application process. You must be at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into a binding agreement. All accounts are subject to our approval and successful completion of Know Your Customer (KYC) verification.

1.2 Account Types and Eligibility

We offer various account types, each with specific features, requirements, and fee structures. Eligibility for certain account types may depend on factors including residency status, credit history, and intended use. The specific terms applicable to each account type are provided at account opening and are incorporated into these Terms by reference.

1.3 Account Maintenance

You are responsible for keeping your account information up to date. You must notify us promptly of any changes to your name, address, email, phone number, or any other information relevant to your account. Failure to maintain accurate information may result in service interruptions or account restrictions.

1.4 Account Closure

You may close your account at any time by submitting a closure request through your dashboard or by contacting customer support. We reserve the right to close or suspend your account at our discretion, including for reasons such as violation of these Terms, suspected fraudulent activity, regulatory requirements, or extended inactivity. Upon closure, any remaining balance will be returned to you after deducting any outstanding fees or obligations.

2. Transaction Terms

2.1 Authorisation

All transactions, including transfers, bill payments, and withdrawals, must be authorised using your transaction PIN or other approved authentication method. You are solely responsible for all transactions authorised with your credentials. You must not share your PIN, password, or authentication codes with anyone.

2.2 Transfer Processing

Transfer processing times vary depending on the type of transfer, destination, currency, and intermediary institutions. While we strive to process transfers promptly, we do not guarantee specific completion times. You are responsible for ensuring that recipient details are accurate; we are not liable for transfers sent to incorrect accounts due to erroneous information provided by you.

2.3 Transaction Limits

Daily and per-transaction limits apply to transfers and payments. These limits vary based on your account type, verification level, and transaction history. You can view your current limits in your dashboard. We may adjust limits at our discretion for security or regulatory reasons.

2.4 Fees and Charges

Applicable fees for services such as international transfers, expedited processing, and card replacements are disclosed on our website and within your dashboard. By initiating a transaction subject to a fee, you authorise us to deduct the applicable fee from your account. Fee schedules may be updated from time to time; we will provide notice of material changes.

3. Card Terms

3.1 Card Issuance and Use

Debit cards are issued upon request and remain the property of the Bank. You must sign your card immediately upon receipt and keep it in a secure location. Cards may only be used by the named account holder. You must not allow any other person to use your card.

3.2 Card Security

You must take reasonable steps to protect your card and PIN from loss, theft, or unauthorised use. This includes not writing your PIN on the card, not storing your PIN with the card, and not sharing your PIN with anyone. If your card is lost, stolen, or you suspect unauthorised use, you must notify us immediately.

3.3 Lost or Stolen Cards

You can freeze your card instantly through your online banking dashboard. You must also report the loss or theft to us without undue delay. You may be liable for unauthorised transactions that occur before you notify us, subject to applicable law and our investigation. Once reported, the card will be cancelled and a replacement issued.

3.4 Virtual Cards

Virtual cards are digital-only payment instruments generated through your dashboard for online transactions. They are subject to the same security obligations as physical cards. Virtual cards can be created, paused, or deleted at any time through your dashboard.

4. User Responsibilities

4.1 Account Security

You are responsible for maintaining the confidentiality of your login credentials, PIN, and all authentication methods associated with your account. You must:

  • Choose a strong, unique password and change it periodically
  • Never share your credentials with any third party
  • Log out after each banking session, especially on shared devices
  • Immediately report any suspected unauthorised access or suspicious activity
  • Keep your contact information current so we can reach you about security matters

4.2 Accurate Information

You represent and warrant that all information you provide to us is true, accurate, and complete. Providing false or misleading information constitutes a breach of these Terms and may result in account suspension or closure, as well as potential legal consequences.

4.3 Prohibited Activities

You agree not to use our services for any unlawful purpose or in violation of these Terms. Prohibited activities include, but are not limited to:

  • Money laundering, terrorist financing, or any other financial crime
  • Fraud, identity theft, or misrepresentation
  • Circumventing transaction limits or security measures
  • Using the account for business purposes not declared at account opening
  • Any activity that could damage, disable, or impair our systems or services

5. Liability

5.1 Our Liability

We are liable for direct losses caused by our failure to exercise reasonable care and skill in providing our services. We are not liable for losses resulting from:

  • Your failure to comply with these Terms, including security obligations
  • Circumstances beyond our reasonable control (force majeure events)
  • Third-party service interruptions, including payment networks and telecommunications providers
  • Your provision of incorrect or incomplete information
  • Unauthorised access resulting from your failure to protect your credentials

5.2 Your Liability

You may be liable for unauthorised transactions if you have acted fraudulently, intentionally, or with gross negligence in protecting your credentials. You are responsible for reviewing your account statements and transaction history regularly and reporting any discrepancies within 30 days of the transaction date.

6. Changes to These Terms

We may amend these Terms from time to time. For material changes, we will provide at least 30 days' notice by email (to your registered email address) or through a prominent notice on our website. Your continued use of our services after the effective date of any changes constitutes acceptance of the revised Terms. If you do not agree with the changes, you may close your account before the changes take effect.

7. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or our services shall first be addressed through good-faith negotiation. If negotiation fails, the dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, unless otherwise required by applicable law. Nothing in this section limits your right to approach your local financial ombudsman or regulatory authority.
